Case Status & Processing Times

Information regarding case status & processing times is often unreliable or out of date.  Clients should only use posted processing times as a guide and should not be surprised if their case takes significantly longer or shorter than the posted times.  the firm will conduct status inquiries on cases filed by it from time to time, but only after the case is significantly beyond normal processing times.

DOL - Labor Certification - Processing Times are Currently Unavailable.  All applications filed prior to March 28, 2005 are in the process of being transferred to one of two (2) regional Backlog Reductions Centers.  The Current Backlog of pending Labor Certification cases (as of May 2005) is approximately 350,000 cases nationwide.  The BRC will process the cases on a First In First Out (FIFO) Basis.   At this time, it is not possible to predict or provide a reliable estimate of additional processing time in Labor Certification Cases.  (The backlog centers are issuing Center Receipt Notices to all employers requesting confirmation of the employers intent to continue processing these long delayed cases and documentation proving the existence and location of the employer.  We recommend that employers contact your attorney immediately if you receive this ar any correspondence from the Department of Labor to ensure a proper response is filed.
