Extension of Work Authorization

for "STEM" Students

with Optional Practical Training

(August 2008)

 

Good news for employers with F-1 Student Visa holders that are employed under the authority of OPT (Optional Practical Training) and have a STEM degree.  The student may be eligible for a 17 month extension of employment authorization.    Here are some of the key requirements for this type of OPT extension:  

  1. Employer must be enrolled in E-Verify and be issued E-Verify Company ID administered by the Social Security Administration (register at www.uscis.gov/E-Verify )
  2. Employer must notify DSO (Designated School Official) with 48 hour notice of termination of employment at the contact information listed on the Form I-20 (USCIS may implement a different method of notification)
  3. New maximum total OPT (Optional Practical Training) period is 29 months (represents 17 month increase over current maximum)
  4. Student must report to DSO every 6 months after initial first 12 months of OPT
  5. DSO must recommend OPT extension and issue a new I-20 with 17 month extension recommendation
  6. Student must apply for new Employment Authorization Document with USCIS on Form I-765 with fees and supporting documentation
